These Terms and Conditions have been prepared to clearly explain the contractual relationship between Maasai Way Safaris ("the Company", "we", "our", or "us") and every traveler ("the Client", "traveler", "guest", or "you") who books services through our company.

The purpose of these Terms is not only to establish the legal framework governing our services but also to ensure complete transparency regarding bookings, payments, cancellations, responsibilities, safety standards, and operational procedures before your journey begins.

We encourage every client to read this document carefully. Understanding these Terms before confirming your reservation helps avoid misunderstandings and allows both parties to enjoy a smooth and successful travel experience.

By proceeding with a reservation, making a payment, signing a booking agreement, or participating in any tour operated by Maasai Way Safaris, you acknowledge that you have read, understood, and accepted these Terms and Conditions in their entirety.

Where individual tours require additional policies due to their unique operational requirements, such provisions shall supplement these Terms rather than replace them.

Our Commitment to You

At Maasai Way Safaris, every journey begins with a commitment to excellence. We understand that many of our guests travel thousands of kilometers to experience Tanzania, often planning their adventure months or even years in advance. For many travelers, a safari or Kilimanjaro climb represents a once-in-a-lifetime experience, and we consider it a privilege to be entrusted with making that experience exceptional.

Our commitment extends beyond simply providing transportation, accommodation, or guiding services. We strive to create journeys that are professionally organized, ethically operated, environmentally responsible, and tailored to the individual expectations of every traveler.

We are committed to maintaining the highest standards of safety throughout our operations. Our safari vehicles are maintained according to professional operational standards, our mountain teams receive ongoing training, and our guides possess extensive local knowledge of Tanzania's national parks, wildlife behavior, mountain environments, and cultural heritage.

We also recognize our responsibility toward conservation. Tanzania is home to some of the world's most extraordinary ecosystems, and every traveler shares in the responsibility of protecting them. Maasai Way Safaris actively supports responsible tourism practices that minimize environmental impact while respecting wildlife, local communities, and protected areas.

Transparency forms an essential part of our business philosophy. We believe our clients should clearly understand what is included in their itinerary, what is excluded, the financial obligations associated with their booking, and the circumstances under which changes may occur. Whenever operational circumstances require adjustments to an itinerary, we will communicate those changes as promptly as reasonably possible.

We are equally committed to treating every traveler with professionalism, courtesy, and respect regardless of nationality, ethnicity, religion, gender, age, or background. Our team endeavors to provide services that reflect the renowned hospitality of Tanzania while maintaining international standards of customer care.

Although we make every reasonable effort to deliver every itinerary exactly as planned, travel within natural environments is inherently dynamic. Weather conditions, wildlife movements, road conditions, government regulations, conservation requirements, and other operational factors occasionally require flexibility. When such situations arise, our priority will always be the safety of our guests while seeking practical alternatives that preserve the quality of the travel experience.

Our commitment is to act honestly, responsibly, and professionally at every stage of your journey.

Acceptance of These Terms

These Terms and Conditions constitute the entire agreement between Maasai Way Safaris and the Client concerning all travel services provided by the Company unless expressly varied by a written agreement signed by both parties.

Acceptance of these Terms occurs immediately upon any of the following actions:

  • Submission of a booking request through our website.
  • Confirmation of a reservation by email.
  • Payment of a booking deposit.
  • Payment of the full tour cost.
  • Acceptance of a travel quotation.
  • Participation in any service operated by Maasai Way Safaris.

The individual completing the booking on behalf of other travelers confirms that they possess the authority to accept these Terms on behalf of every member of their travel party. Each traveler included within the reservation shall therefore be deemed to have accepted these Terms and Conditions regardless of whether they have personally signed any documentation.

Clients are encouraged to review these Terms carefully before making any payment. Should any provision require clarification, Maasai Way Safaris welcomes inquiries prior to confirmation of the booking. Entering into a travel agreement without seeking clarification shall not invalidate these Terms or relieve either party from their respective obligations.

No verbal representation, informal communication, social media conversation, marketing material, promotional content, or statement made by any employee or representative shall modify these Terms unless such modification has been confirmed in writing by an authorized representative of Maasai Way Safaris.

These Terms remain applicable throughout the planning process, during the travel period, and following the completion of the booked services where relevant obligations continue to apply, including matters relating to complaints, liability, refunds, intellectual property, and dispute resolution.

Should any provision within these Terms be determined to be invalid or unenforceable under the applicable laws of the United Republic of Tanzania, the remaining provisions shall continue in full force and effect.

Maasai Way Safaris reserves the right to amend these Terms and Conditions periodically in response to changes in legislation, operational practices, supplier requirements, or industry standards. Any amendments shall apply only to bookings confirmed after the revised Terms have been published, unless otherwise required by law. Clients with confirmed bookings will continue to be governed by the version of the Terms that was in effect at the time their booking was accepted, unless both parties mutually agree in writing to adopt a later version.

By confirming a booking with Maasai Way Safaris, the Client acknowledges that these Terms and Conditions have been made available, have been read or had the opportunity to be read, and are accepted in full as the governing agreement between the Client and the Company.

Definitions

For the purpose of these Terms and Conditions, the following words and expressions shall have the meanings assigned to them below unless the context requires otherwise.

"Company," "We," "Us," or "Our" refers to Maasai Way Safaris, a licensed tour operator incorporated and operating under the laws of the United Republic of Tanzania, together with its directors, employees, guides, representatives, contractors, and authorized service providers.

"Client," "Traveler," "Guest," "Passenger," or "You" refers to any individual whose booking has been accepted by Maasai Way Safaris, including every participant listed within a confirmed reservation, regardless of who completed the booking or made payment.

"Booking" means any confirmed reservation for services offered by Maasai Way Safaris, whether arranged directly through our website, by email, telephone, social media, travel advisor, or any authorized distribution partner.

"Tour" includes every service offered by Maasai Way Safaris, including but not limited to wildlife safaris, Mount Kilimanjaro expeditions, Mount Meru treks, Zanzibar holidays, day excursions, airport transfers, cultural experiences, photographic safaris, luxury itineraries, camping adventures, and custom-designed travel programs.

"Quotation" means a written travel proposal prepared by Maasai Way Safaris outlining the itinerary, estimated pricing, inclusions, exclusions, accommodation standards, transportation arrangements, and any additional conditions applicable to the proposed journey.

"Deposit" refers to the initial payment required to secure a booking and authorize Maasai Way Safaris to begin confirming accommodations, permits, transportation, park reservations, flights, mountain crews, guides, and other travel services associated with the itinerary.

"Force Majeure" means any extraordinary event or circumstance beyond the reasonable control of either party that prevents or substantially interferes with the performance of contractual obligations. Such events may include, but are not limited to, natural disasters, severe weather, floods, earthquakes, epidemics, pandemics, government restrictions, civil unrest, war, terrorism, strikes, transportation disruptions, airline cancellations, road closures, national park closures, or other unforeseeable circumstances.

"Supplier" refers to any third-party organization contracted to provide services forming part of the Client's itinerary, including hotels, lodges, tented camps, airlines, marine operators, domestic flight providers, restaurants, transportation companies, national parks, conservation authorities, or other tourism-related businesses.

"National Park Fees" refer to entrance fees, concession fees, camping fees, rescue fees, conservation fees, crater service fees, mountain rescue charges, or any government-imposed tourism charges applicable within Tanzania's protected areas.

Where singular words appear within these Terms, they shall also include the plural where appropriate, and words expressed in the masculine, feminine, or neutral form shall be interpreted equally unless the context clearly indicates otherwise.

Headings are included solely for convenience and shall not influence the interpretation of these Terms and Conditions.

Should any ambiguity arise regarding the interpretation of these Terms, the version maintained by Maasai Way Safaris in English shall prevail.

Booking Your Journey

Every unforgettable journey begins with careful planning. At Maasai Way Safaris, we have developed a booking process designed to ensure clarity, transparency, and efficiency from your first inquiry until your arrival in Tanzania.

Clients may request a quotation by contacting Maasai Way Safaris through our official website, email, telephone, WhatsApp, social media channels, or any other communication platform officially managed by the Company. To prepare an accurate proposal, we may request information including preferred travel dates, number of participants, accommodation preferences, destinations, budget expectations, flight schedules, dietary requirements, and any special requests relevant to the journey.

Following receipt of this information, our travel consultants will prepare a personalized itinerary together with a detailed quotation outlining the proposed services, accommodation standards, transportation arrangements, estimated pricing, and applicable inclusions and exclusions.

Submission of a quotation does not constitute a confirmed booking. All itineraries remain subject to the availability of accommodation, national park permits, mountain crew availability, domestic flights, vehicle scheduling, and other operational requirements until written confirmation has been issued by Maasai Way Safaris.

Clients are encouraged to review their quotation carefully before acceptance. Particular attention should be given to travel dates, accommodation categories, room occupancy, route selection, included activities, transportation arrangements, and payment schedules. Any discrepancies should be communicated immediately so that corrections may be made prior to confirmation.

Upon acceptance of the quotation, the Client will receive instructions for payment of the required booking deposit. Once the deposit has been received, Maasai Way Safaris will begin confirming the services included within the itinerary.

A booking shall only be regarded as confirmed when all of the following conditions have been satisfied:

  • The Client has accepted the proposed itinerary.
  • The required deposit or full payment has been received in accordance with the agreed payment schedule.
  • Availability has been confirmed for the requested services.
  • Written confirmation has been issued by Maasai Way Safaris.

Until written confirmation has been provided, the Company reserves the right to amend the itinerary where operational circumstances require alternative arrangements of equivalent standard.

Where a requested hotel, lodge, camp, or activity becomes unavailable prior to confirmation, Maasai Way Safaris shall make every reasonable effort to secure a comparable alternative offering a similar category, location, and level of service. Should no comparable alternative be available, the Client shall be informed promptly and presented with available options before proceeding.

Clients booking on behalf of additional travelers acknowledge responsibility for ensuring that all members of their party receive relevant travel information, comply with these Terms and Conditions, and provide accurate personal details required for travel documentation.

The Client further confirms that all information supplied during the booking process, including passport details, travel dates, contact information, dietary requirements, and medical disclosures, is accurate to the best of their knowledge. Maasai Way Safaris shall not be responsible for delays, losses, or additional expenses arising from inaccurate or incomplete information provided by the Client.

Prices & Quotations

Every quotation prepared by Maasai Way Safaris is based upon the information available at the time it is issued. Our pricing reflects the cost of accommodation, transportation, national park fees, conservation charges, guide services, mountain operations, government taxes, supplier rates, and operational expenses applicable on the date of preparation.

Unless otherwise stated in writing, quotations remain valid for a period of 14 days from the date of issue. After this period, prices may be revised to reflect changes in supplier costs, government regulations, exchange rate fluctuations, or operational expenses.

Because tourism services within Tanzania frequently involve third-party suppliers, Maasai Way Safaris cannot guarantee the continued availability of accommodation, domestic flights, mountain permits, or transportation until the required booking deposit has been received and written confirmation has been issued.

All quotations clearly identify the services included within the proposed itinerary together with any exclusions. Clients are encouraged to review these carefully before confirming their reservation.

Unless specifically stated otherwise, quotations generally exclude:

  • International flights
  • Visa fees
  • Passport costs
  • Comprehensive travel insurance
  • Vaccinations
  • Personal expenses
  • Laundry services
  • Alcoholic beverages
  • Tips and gratuities
  • Optional excursions
  • Items of a personal nature

National Park fees within Tanzania are established by the relevant government authorities and remain subject to change without prior notice. Where such increases occur before full payment has been received, Maasai Way Safaris reserves the right to adjust the quotation accordingly to reflect the revised government charges.

Similarly, significant fluctuations in fuel prices, taxation, conservation levies, airline surcharges, or supplier pricing may require corresponding adjustments where such increases are imposed after the quotation has been prepared but before the booking has been fully confirmed.

Once full payment has been received and written confirmation issued, Maasai Way Safaris will not increase the agreed tour price except where additional costs arise directly from changes requested by the Client or mandatory government-imposed charges introduced after confirmation and beyond the Company's reasonable control.

The Company is committed to maintaining complete transparency regarding pricing. No hidden operational charges will be added without prior communication to the Client. Where optional services become available during travel, participation shall remain entirely at the Client's discretion.

Errors occasionally occur despite careful preparation. Maasai Way Safaris reserves the right to correct typographical errors, calculation errors, currency conversion inaccuracies, or pricing mistakes identified before booking confirmation. Where such corrections materially affect the total cost of the itinerary, the Client shall be informed immediately and may choose either to accept the revised quotation or cancel the proposed booking without penalty.

Payment Terms

To ensure the smooth coordination of every journey, Maasai Way Safaris requires payments to be made in accordance with the schedule specified within the booking confirmation. Timely payment enables the Company to secure accommodations, transportation, park permits, mountain crews, domestic flights, and other services that often require advance confirmation.

Unless otherwise agreed in writing, a deposit of thirty percent (30%) of the total booking value is required to confirm most safari, Zanzibar holiday, and cultural tour reservations. Certain itineraries involving luxury lodges, exclusive-use properties, scheduled flights, or special permits may require a higher deposit where requested by third-party suppliers. In such cases, the Client will be informed before confirming the reservation.

The remaining balance shall ordinarily be payable no later than thirty (30) days prior to the scheduled commencement of the tour. Reservations made within thirty days of departure generally require full payment at the time of booking.

Payments may be made by bank transfer, approved online payment gateway, debit card, credit card, or any other payment method expressly accepted by Maasai Way Safaris. Clients remain responsible for any bank charges, transfer fees, currency conversion costs, or payment processing fees imposed by financial institutions unless otherwise agreed in writing.

Where payment is made in a currency different from that specified within the booking confirmation, the applicable exchange rate shall be determined by the receiving financial institution or payment platform on the date the transaction is processed.

Should the Company fail to receive payment by the specified due date, Maasai Way Safaris reserves the right to suspend further booking arrangements, release reserved accommodations or services, or cancel the reservation following reasonable written notice to the Client.

Where payment is received after supplier cancellation deadlines have passed, additional charges may become payable due to the need to secure replacement accommodation, transportation, or other services. Such costs shall be communicated to the Client before any revised arrangements are confirmed.

For security reasons, Maasai Way Safaris does not accept responsibility for payments made to unauthorized bank accounts or individuals claiming to represent the Company. Clients are strongly advised to verify payment instructions using official Company communication channels before transferring funds.

Upon receipt of every payment, the Client shall receive written confirmation together with an updated account statement reflecting the remaining balance, if any. Clients are encouraged to retain copies of all payment confirmations until the completion of their journey.

Failure to settle outstanding balances within the agreed timeframe may result in cancellation of the booking in accordance with the Company's cancellation policy, without prejudice to any rights or remedies available under these Terms and Conditions.

Booking Confirmation

The confirmation of a booking marks the commencement of the contractual relationship between Maasai Way Safaris and the Client. It signifies that the Company has accepted the Client's reservation request and has commenced the process of securing the services necessary to operate the agreed itinerary.

A booking shall only be considered confirmed when all of the following conditions have been satisfied:

  • The Client has accepted the proposed itinerary and quotation in writing.
  • The required deposit or full payment has been received in accordance with the agreed payment schedule.
  • Availability has been confirmed for all essential services forming part of the itinerary.
  • Maasai Way Safaris has issued an official Booking Confirmation by email or another authorized communication channel.

Prior to confirmation, all quoted accommodations, transportation, domestic flights, mountain permits, park reservations, and additional services remain subject to availability. While Maasai Way Safaris makes every reasonable effort to secure the exact services requested by the Client, availability cannot be guaranteed until confirmation has been issued.

Upon confirmation, the Client will receive a comprehensive travel package which may include:

  • Official Booking Confirmation
  • Travel Itinerary
  • Payment Receipt
  • Outstanding Balance Statement (where applicable)
  • Arrival Information
  • Packing Recommendations
  • Visa Guidance
  • Emergency Contact Information
  • Pre-Departure Travel Information

The Client is responsible for reviewing all confirmation documents immediately upon receipt. Any inaccuracies relating to travel dates, names, accommodation preferences, room occupancy, flight schedules, passport information, or special requests must be reported to Maasai Way Safaris without delay.

Failure to notify the Company of any inaccuracies within a reasonable period may result in additional costs where corrections require amendments to supplier reservations or government permits.

Following confirmation, Maasai Way Safaris shall begin coordinating the operational elements of the Client's journey. This may include confirming accommodation reservations, allocating safari vehicles, assigning professional guides, arranging domestic transportation, securing National Park permits, scheduling mountain crews, confirming airport transfers, and finalizing additional services included within the itinerary.

The Company reserves the right to request additional information after confirmation where required for operational, immigration, safety, or supplier purposes. Clients agree to provide such information promptly in order to avoid unnecessary delays.

Booking confirmation does not exempt the Client from complying with subsequent payment deadlines, travel documentation requirements, health declarations, or any other obligations contained within these Terms and Conditions.

Changes Before Departure

Maasai Way Safaris understands that travel plans occasionally change due to personal circumstances, international flight schedules, family commitments, or unforeseen events. Wherever reasonably possible, the Company will make every effort to accommodate requested changes before the commencement of travel.

Requests to amend a confirmed booking must be submitted in writing by the Client using the same communication channel through which the reservation was confirmed or another official Company communication channel. Verbal requests cannot be considered official until confirmed in writing.

Changes may include, but are not limited to:

  • Change of travel dates
  • Modification of itinerary
  • Addition or removal of destinations
  • Accommodation upgrades or downgrades
  • Vehicle upgrades
  • Changes in participant numbers
  • Domestic flight modifications
  • Additional activities
  • Extension of the itinerary
  • Airport transfer adjustments

All amendment requests remain subject to operational feasibility and the availability of accommodation, transportation, guides, permits, and other suppliers.

Where requested changes result in increased operational costs, additional supplier charges, revised park fees, or administrative expenses, such costs shall be communicated to the Client before any amendment is confirmed.

Certain third-party suppliers maintain strict amendment policies. Hotels, airlines, mountain authorities, marine operators, and National Parks may impose amendment fees which are beyond the control of Maasai Way Safaris. Such fees shall remain the responsibility of the Client where applicable.

Where an amendment significantly alters the original itinerary, Maasai Way Safaris reserves the right to prepare a revised quotation reflecting the updated services.

Although every effort will be made to accommodate requested changes, the Company cannot guarantee that all modifications will be possible once supplier reservations have been confirmed.

Should requested amendments be impossible due to supplier restrictions or operational limitations, the original booking conditions shall continue to apply unless otherwise agreed in writing.

Clients are encouraged to notify Maasai Way Safaris of any anticipated changes as early as possible. Early communication significantly increases the likelihood that suitable alternatives can be arranged while minimizing additional costs.

Cancellation by the Client

We understand that circumstances beyond a traveler's control may require the cancellation of a confirmed journey. While Maasai Way Safaris will always seek to assist clients wherever reasonably possible, cancellations often involve financial commitments that have already been made to accommodation providers, National Parks, transportation companies, mountain crews, domestic airlines, and other suppliers.

Accordingly, all cancellations must be submitted in writing by the Client. The effective date of cancellation shall be the date on which written notice is received by Maasai Way Safaris.

Failure to commence the tour on the scheduled departure date, voluntary withdrawal after the tour has commenced, failure to arrive due to missed flights, denied boarding, visa refusal, illness, or any other circumstance preventing participation shall be treated as a cancellation by the Client unless otherwise agreed by the Company.

Cancellation charges are necessary because many tourism services require advance payment and become non-refundable once confirmed.

Unless otherwise stated in the Client's Booking Confirmation, the following cancellation schedule shall generally apply:

Safari, Zanzibar and Cultural Tours

  • More than 60 days before arrival – Deposit refundable less any non-recoverable supplier costs and administrative charges.
  • 31–60 days before arrival – 30% of the total booking value.
  • 15–30 days before arrival – 50% of the total booking value.
  • 8–14 days before arrival – 75% of the total booking value.
  • 7 days or less before arrival, no-show, or failure to commence travel – 100% of the booking value.

Certain luxury lodges, charter flights, exclusive-use camps, Kilimanjaro expeditions, or special permit itineraries may be subject to different cancellation conditions imposed by suppliers. Where applicable, these conditions shall be communicated before booking confirmation and shall form part of the travel agreement.

No refund shall be payable for services voluntarily not used during the tour, including unused accommodation nights, meals, game drives, transfers, activities, or early departure from the itinerary.

Where cancellation results from circumstances covered by the Client's travel insurance policy, the Client should submit their claim directly to their insurance provider. Maasai Way Safaris will provide supporting documentation where reasonably required to facilitate the insurance claim.

The Company strongly recommends purchasing comprehensive travel insurance immediately after confirming the booking to protect against cancellation costs arising from unforeseen events.

Cancellation by Maasai Way Safaris

Although cancellations initiated by Maasai Way Safaris are extremely rare, certain exceptional circumstances may require the Company to modify or cancel a confirmed booking in the interests of safety, operational integrity, legal compliance, or circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • Government restrictions.
  • National Park closures.
  • Severe weather conditions.
  • Civil unrest.
  • Public health emergencies.
  • Airline suspension of essential transport services.
  • Security concerns.
  • Natural disasters.
  • Supplier insolvency.
  • Road closures or infrastructure failure.
  • Any circumstance that renders the safe operation of the itinerary impossible or commercially impracticable.

Where such circumstances arise, Maasai Way Safaris shall notify the Client as soon as reasonably practicable.

Depending upon the circumstances, the Company may offer one or more of the following options:

  • Rescheduling the journey to a mutually agreed future date.
  • Providing an alternative itinerary of comparable value.
  • Substituting accommodation with an equivalent or higher standard.
  • Issuing a travel credit for future use.
  • Providing a refund for services that cannot reasonably be delivered.

Refunds shall exclude any non-recoverable payments already made to third-party suppliers where such suppliers refuse reimbursement despite reasonable efforts by Maasai Way Safaris.

The Company shall not be liable for indirect expenses incurred by the Client, including but not limited to international flights, visa costs, vaccinations, personal equipment purchases, travel insurance premiums, loss of income, accommodation booked independently, or any consequential losses arising from the cancellation.

Where operational changes are minor and do not materially affect the quality or overall nature of the itinerary, Maasai Way Safaris reserves the right to make reasonable substitutions without constituting cancellation of the travel agreement.

Examples of reasonable substitutions include:

  • Alternative accommodation of similar or higher standard.
  • Replacement safari vehicle.
  • Different guide.
  • Adjusted game drive schedules.
  • Alternative routes due to road conditions.
  • Minor timing adjustments.
  • Comparable activities where originally scheduled activities become unavailable.

Every effort shall be made to minimize inconvenience while maintaining the quality and safety of the travel experience.

Force Majeure

Travel within East Africa occasionally takes place in environments where events beyond the control of either the Client or Maasai Way Safaris may affect the operation of an itinerary. Such extraordinary events, commonly referred to as Force Majeure, cannot reasonably be predicted, prevented, or avoided despite the exercise of due care and professional planning.

For the purposes of these Terms and Conditions, Force Majeure includes, but is not limited to:

  • Natural disasters, including earthquakes, floods, landslides, volcanic activity, wildfires, or severe storms.
  • Epidemics, pandemics, or public health emergencies.
  • Government travel advisories or restrictions.
  • Closure of international borders.
  • Armed conflict, terrorism, civil unrest, riots, political instability, or military action.
  • National strikes affecting transportation or essential tourism services.
  • Sudden closure of National Parks or protected areas.
  • Significant wildlife emergencies affecting visitor safety.
  • Extreme weather conditions making travel unsafe.
  • Airline cancellations or suspension of scheduled services.
  • Road closures, bridge failures, or infrastructure damage.
  • Utility failures, including communication outages or prolonged power interruptions.
  • Any other event beyond the reasonable control of either party.

Where a Force Majeure event occurs, Maasai Way Safaris shall not be deemed to have breached these Terms and Conditions by reason of any delay, modification, or inability to perform contractual obligations resulting directly from such circumstances.

The Company will, however, use all reasonable efforts to reduce disruption to the Client's journey. This may include revising the itinerary, postponing travel dates, arranging substitute accommodation, selecting alternative destinations, or rescheduling activities where practical.

Where additional operational costs arise directly from Force Majeure events—including increased transportation expenses, additional accommodation, emergency rerouting, or revised supplier charges—such costs may become the responsibility of the Client if they are not recoverable through travel insurance.

Clients are therefore strongly advised to maintain comprehensive travel insurance covering trip interruption, cancellation, emergency evacuation, medical expenses, and Force Majeure-related events.

Neither Maasai Way Safaris nor the Client shall be liable to the other for losses arising solely from Force Majeure circumstances. Both parties agree to cooperate in good faith to identify practical solutions that prioritize traveler safety while preserving the overall quality of the travel experience wherever reasonably possible.

The occurrence of a Force Majeure event shall not automatically entitle either party to terminate the travel agreement where reasonable alternative arrangements remain available and can be implemented safely and fairly.

Accommodation Standards

Maasai Way Safaris is committed to providing accommodation that reflects the category, comfort level, and overall experience described within the confirmed itinerary. Accommodation forms an important part of every journey, whether guests are enjoying luxury safari lodges, intimate tented camps, comfortable mid-range properties, budget camping experiences, mountain huts, or beach resorts in Zanzibar.

All accommodations included within our itineraries are carefully selected based on factors including safety, cleanliness, location, service standards, hospitality, environmental responsibility, and overall guest experience. We regularly evaluate our accommodation partners to ensure they continue to meet the standards expected by our clients and our company.

Unless otherwise specified within the confirmed itinerary, accommodation rates are based on standard room occupancy. Requests for single rooms, family rooms, adjoining rooms, honeymoon suites, wheelchair-accessible rooms, or other specific arrangements should be communicated during the booking process. While Maasai Way Safaris will make every reasonable effort to secure such requests, availability cannot be guaranteed unless confirmed in writing.

Accommodation providers operate according to their own internal policies regarding check-in times, check-out times, meal service, maintenance schedules, and guest facilities. Clients agree to comply with these policies during their stay.

In exceptional circumstances beyond the Company's reasonable control, including overbooking, emergency maintenance, operational issues, supplier insolvency, severe weather, or government directives, the originally confirmed accommodation may become unavailable.

Should this occur, Maasai Way Safaris reserves the right to substitute the accommodation with another property offering a comparable or higher standard of comfort, service, and location whenever reasonably possible. Such substitutions shall not constitute a breach of contract provided the alternative accommodation offers substantially similar quality.

Guests acknowledge that accommodation standards within remote safari areas differ significantly from those found in major international cities. Many safari lodges and tented camps operate in isolated wilderness locations where electricity, internet connectivity, water supply, and communication infrastructure may be intentionally limited as part of sustainable tourism practices.

These characteristics should be viewed as an integral part of the authentic safari experience rather than deficiencies in service.

Mountain accommodation during Mount Kilimanjaro expeditions is determined by the selected climbing route. Depending upon the route, climbers may stay in mountain huts or expedition tents designed specifically for high-altitude environments. Such accommodation is intentionally basic due to the logistical challenges associated with operating at high elevations.

The Company cannot accept responsibility for temporary interruptions to accommodation facilities resulting from circumstances beyond its control, including power outages, internet interruptions, water shortages, wildlife activity, maintenance work, or local infrastructure failures.

Clients are expected to respect accommodation facilities, furnishings, equipment, and property belonging to accommodation providers. Any damage resulting from negligent or intentional acts committed by the Client may result in additional charges payable directly to the accommodation provider or reimbursed through Maasai Way Safaris.

Safari Operations

Wildlife safaris conducted by Maasai Way Safaris are designed to provide safe, educational, environmentally responsible, and memorable experiences within Tanzania's protected areas. Every safari is carefully planned using experienced professional guides, specially equipped safari vehicles, and established operational procedures developed through years of experience within Tanzania's National Parks.

Safari itineraries are prepared according to the confirmed travel program; however, flexibility remains essential due to changing weather conditions, wildlife movements, park regulations, road conditions, conservation requirements, and operational circumstances beyond the Company's control.

Daily departure times may vary depending upon wildlife activity, park opening hours, weather forecasts, seasonal migration patterns, and guest requirements. Our guides reserve the discretion to adjust game drive schedules where doing so enhances wildlife viewing opportunities or improves guest safety.

Safari vehicles are specifically selected for off-road conditions commonly encountered within Tanzania's protected areas. Although every vehicle undergoes routine inspection and maintenance before departure, unexpected mechanical issues may occasionally occur due to the demanding operating environment.

In the unlikely event of a mechanical breakdown, Maasai Way Safaris will make every reasonable effort to repair the vehicle promptly or provide an appropriate replacement as soon as operationally possible. While temporary delays may occur, the Company will prioritize minimizing disruption to the Client's itinerary.

Guests are expected to follow all safety instructions provided by their guide throughout the safari. This includes remaining seated while the vehicle is in motion, avoiding unnecessary noise around wildlife, keeping body parts inside the vehicle where instructed, and respecting all National Park regulations.

Leaving the safari vehicle is only permitted in designated areas or when expressly authorized by the guide. Unauthorized departure from the vehicle within protected areas may place guests at serious risk and may constitute a violation of National Park regulations.

Smoking inside safari vehicles is prohibited unless expressly permitted by the guide and all other passengers.

The Company reserves the right to refuse participation or remove any individual whose behavior endangers the safety, comfort, or enjoyment of other guests, staff members, wildlife, or local communities. Such removal shall not entitle the Client to any refund or compensation.

Wildlife Viewing

One of the greatest attractions of Tanzania is its extraordinary wildlife. Every year, travelers visit our National Parks hoping to witness the Great Migration, encounter the Big Five, observe predators in action, or experience unforgettable moments in one of the world's last great wildernesses.

While Maasai Way Safaris employs experienced guides with extensive knowledge of animal behavior, migration routes, seasonal movements, and protected ecosystems, wildlife remains entirely wild and unpredictable.

The Company cannot guarantee sightings of any specific animal, including but not limited to lions, leopards, rhinos, elephants, buffaloes, cheetahs, wildebeest migration crossings, or any other species.

Animal movements are influenced by rainfall, seasonal migration, breeding cycles, food availability, water sources, habitat conditions, conservation management, and countless natural factors beyond human control.

Every safari therefore offers a unique experience, and no two game drives are ever identical.

Our guides continuously communicate with other professional guides, monitor wildlife activity, and utilize their local expertise to maximize viewing opportunities while always respecting conservation regulations and responsible wildlife viewing practices.

Clients acknowledge that the absence of sightings of particular animals shall not constitute failure by Maasai Way Safaris to provide the contracted services.

Guests agree to maintain appropriate behavior around wildlife at all times.

This includes:

  • Remaining quiet during animal encounters.
  • Never attempting to feed wildlife.
  • Never provoking animals for photographs.
  • Never throwing objects from the vehicle.
  • Never requesting guides to violate park regulations.
  • Respecting minimum viewing distances where required.

Wild animals possess natural instincts and may behave unpredictably regardless of previous observations.

For this reason, all interactions with wildlife involve an inherent element of risk.

Clients participate in safari activities with full understanding of these natural risks and agree to follow the instructions of their guide at all times.

Failure to comply with guide instructions may result in removal from certain activities where continued participation presents a safety concern.

Mount Kilimanjaro Expeditions

Climbing Mount Kilimanjaro is a physically demanding high-altitude expedition rather than an ordinary hiking excursion. Although technical climbing experience is generally not required, successful ascent depends upon physical fitness, altitude acclimatization, weather conditions, personal health, and numerous individual physiological factors beyond the control of Maasai Way Safaris.

By booking a Kilimanjaro expedition, the Client confirms that they understand the physical nature of the climb and accept the inherent risks associated with trekking at high altitude.

Clients are strongly encouraged to undertake appropriate physical preparation before arrival in Tanzania.

Maasai Way Safaris reserves the right to request medical information where necessary to determine whether participation may present an unacceptable risk.

Every climber must follow the instructions of the assigned mountain guide throughout the expedition.

Our guides conduct routine health monitoring during the climb, including regular observation for symptoms associated with Acute Mountain Sickness (AMS), dehydration, exhaustion, hypothermia, and other altitude-related conditions.

Where deemed appropriate, guides may conduct health assessments using pulse oximeters or other accepted monitoring procedures.

Should a guide determine that continued ascent presents a significant risk to the Client's health or safety, the guide shall have full authority to require the Client to descend immediately.

Such decisions are made solely in the interests of safety and shall be considered final.

Summit success can never be guaranteed.

Factors affecting summit success include altitude adaptation, weather conditions, individual physiology, fitness levels, illness, injury, and other variables beyond the Company's control.

Maasai Way Safaris measures the success of every expedition not solely by reaching Uhuru Peak, but by ensuring that every climber returns safely from the mountain.

Mountain conditions may require itinerary adjustments without prior notice where necessary to protect climber safety or comply with National Park regulations.

Clients agree to respect mountain staff, porters, cooks, guides, and fellow climbers throughout the expedition.

Zanzibar Excursions

Zanzibar offers a diverse range of marine activities, cultural experiences, historical tours, spice farm visits, snorkeling excursions, dolphin tours, diving experiences, dhow cruises, and beach holidays. Maasai Way Safaris carefully selects experienced local partners to operate these activities while maintaining high standards of safety and service.

Marine activities are subject to weather conditions, sea state, tides, visibility, and safety assessments conducted by local authorities and boat captains.

Where conditions are considered unsafe, excursions may be delayed, modified, postponed, or cancelled without prior notice in the interests of passenger safety.

Clients participating in snorkeling, diving, swimming, kayaking, paddleboarding, or other marine activities acknowledge that water-based activities involve inherent risks including currents, waves, marine life, changing weather conditions, and varying swimming abilities.

Participants are responsible for informing the Company of any medical conditions, swimming limitations, pregnancy, or other circumstances that may affect their ability to participate safely.

Life jackets and safety equipment provided by operators must be worn whenever instructed.

Failure to comply with safety instructions may result in exclusion from the activity without entitlement to compensation.

Dolphin encounters, marine wildlife sightings, and underwater visibility cannot be guaranteed. As with terrestrial wildlife, marine animals remain wild and move freely within their natural environment.

Guests are expected to respect marine ecosystems by avoiding contact with coral reefs, refraining from feeding marine wildlife, and following environmentally responsible snorkeling and diving practices.

When visiting cultural villages, historical sites, or places of religious significance, Clients are expected to dress respectfully, behave courteously, and observe local customs and traditions. Maasai Way Safaris believes that responsible cultural tourism is founded upon mutual respect between visitors and host communities.

The Company reserves the right to modify the order of activities, departure times, or routes where operational circumstances, weather, tides, conservation measures, or local authority directives require such changes. Every effort will be made to preserve the overall quality and enjoyment of the excursion while ensuring the safety of all participants.

Health & Medical Conditions

The health, safety, and well-being of our Clients remain the highest priority throughout every journey organized by Maasai Way Safaris. Many of the experiences offered by the Company—including wildlife safaris, mountain trekking, cultural excursions, and marine activities—take place in remote locations where access to advanced medical facilities may be limited compared to urban environments.

Before confirming a booking, every Client is responsible for carefully assessing their own physical fitness, medical condition, and ability to participate in the selected itinerary. By proceeding with a reservation, the Client confirms that they are medically fit to undertake the activities included within their itinerary unless previously disclosed and accepted by the Company.

Clients must notify Maasai Way Safaris, in writing and before travel, of any medical condition, disability, injury, allergy, chronic illness, physical limitation, recent surgery, psychological condition, or other health concern that may reasonably affect their ability to travel safely or require additional assistance during the journey.

Such conditions may include, but are not limited to:

  • Heart or cardiovascular conditions
  • Respiratory illnesses
  • Diabetes
  • Severe allergies
  • Epilepsy
  • Mobility limitations
  • Recent fractures or surgery
  • Anxiety disorders or other mental health conditions requiring special support
  • Any condition requiring regular medication or medical equipment

The purpose of this disclosure is not to prevent participation, but rather to allow Maasai Way Safaris to assess whether appropriate arrangements can reasonably be made to support the Client during their travels.

Failure to disclose relevant medical information before departure may significantly limit the Company's ability to provide appropriate assistance and may increase health and safety risks for both the Client and others participating in the tour.

Maasai Way Safaris reserves the right to request additional medical information, including a physician's certificate confirming fitness to travel, where the nature of the itinerary or disclosed medical condition reasonably warrants such documentation.

Clients remain solely responsible for carrying an adequate supply of personal medication for the entire duration of the journey, together with copies of medical prescriptions where required by customs or immigration authorities. Certain medications may not be readily available in Tanzania, particularly in remote safari areas or on Mount Kilimanjaro.

Where emergency medical treatment becomes necessary during the tour, Maasai Way Safaris will make every reasonable effort to assist the Client in obtaining appropriate medical attention. However, all medical expenses, hospitalization costs, emergency transportation, evacuation fees, prescription costs, and related expenses shall remain the responsibility of the Client unless covered by their travel insurance policy.

The Company cannot accept responsibility for medical complications arising from undisclosed conditions, failure to follow medical advice, failure to carry prescribed medication, or participation in activities against professional medical recommendations.

For mountain expeditions, additional health monitoring procedures apply as described under the Mount Kilimanjaro Expedition Terms.

Pregnancy

Maasai Way Safaris warmly welcomes expectant mothers who wish to experience Tanzania, provided that travel can be undertaken safely and in accordance with appropriate medical guidance.

Clients who are pregnant at the time of booking or who become pregnant before their scheduled departure are required to notify Maasai Way Safaris as soon as reasonably possible.

The suitability of travel during pregnancy depends upon several factors, including the stage of pregnancy, the nature of the itinerary, the Client's overall health, medical advice received from their healthcare provider, and the availability of appropriate medical facilities along the planned route.

Certain activities offered by Maasai Way Safaris may not be suitable during pregnancy, including but not limited to:

  • Mount Kilimanjaro expeditions
  • High-altitude trekking
  • Extended game drives over rough terrain
  • Boat excursions during adverse weather
  • Scuba diving
  • Certain adventure activities

Clients are strongly encouraged to seek advice from a qualified medical professional before confirming any booking involving pregnancy.

Where appropriate, Maasai Way Safaris may request written confirmation from the Client's healthcare provider stating that travel is considered medically suitable.

The Company reserves the right to decline participation in activities where, in its reasonable opinion or upon advice from guides, medical personnel, or local authorities, participation would present an unacceptable risk to the health or safety of the Client or unborn child.

Should a Client choose to participate contrary to medical advice, Maasai Way Safaris accepts no responsibility for any resulting complications.

Where pregnancy results in changes to travel plans before departure, cancellation and amendment provisions contained within these Terms shall apply unless covered under the Client's travel insurance policy.

Children

Maasai Way Safaris is pleased to welcome families traveling with children and recognizes that Tanzania offers extraordinary educational and cultural experiences for travelers of all ages.

The parent, legal guardian, or responsible adult accompanying a child assumes full responsibility for the child's supervision, behavior, health, and safety throughout the entire journey.

Children must remain under appropriate adult supervision at all times, particularly during:

  • Game drives
  • Visits to National Parks
  • Boat excursions
  • Walking safaris
  • Cultural visits
  • Hotel and lodge facilities
  • Airport transfers
  • Any activity involving wildlife or natural environments

The Company may establish minimum age requirements for certain activities based upon safety considerations, National Park regulations, supplier requirements, or operational limitations.

Certain activities—including mountain climbing, extended trekking, scuba diving, and some wildlife experiences—may not be appropriate for younger participants.

Where age restrictions apply, these will be communicated before booking confirmation.

Parents and guardians remain responsible for ensuring that children follow all safety instructions issued by guides, drivers, accommodation staff, and activity providers.

Should the behavior of a child place themselves, other guests, staff members, or wildlife at risk, the guide reserves the authority to suspend participation in specific activities until the situation has been appropriately managed.

Children should be educated regarding appropriate wildlife viewing behavior, respect for local communities, and environmental conservation throughout the journey.

Parents are also responsible for ensuring that children possess all required travel documentation, vaccinations, visas, passports, parental consent documentation where applicable, and any medical supplies necessary during travel.

Maasai Way Safaris accepts no responsibility for delays, denied boarding, or immigration issues resulting from incomplete documentation relating to minors.

Special Requests

Maasai Way Safaris recognizes that every traveler is unique and strives to accommodate individual preferences wherever reasonably possible.

Clients are encouraged to communicate any special requests during the booking process so that appropriate arrangements may be explored well in advance of travel.

Special requests may include, but are not limited to:

  • Honeymoon arrangements
  • Anniversary celebrations
  • Birthday surprises
  • Private dining experiences
  • Room preferences
  • Ground floor accommodation
  • Twin or double bedding
  • Photography-focused itineraries
  • Birdwatching safaris
  • Accessibility requirements
  • Additional luggage arrangements
  • Religious considerations
  • Special cultural experiences
  • Airport assistance
  • Luxury upgrades

The Company will make every reasonable effort to communicate such requests to the relevant accommodation providers, transportation companies, guides, and third-party suppliers.

However, unless specifically confirmed in writing by Maasai Way Safaris, special requests cannot be guaranteed.

Certain requests depend entirely upon availability at the time services are delivered and remain subject to supplier discretion.

Where fulfilling a special request requires additional operational arrangements, supplier charges, or upgraded services, any associated costs shall be communicated to the Client before confirmation.

Failure by a supplier to fulfill a requested preference shall not constitute a breach of these Terms where Maasai Way Safaris has exercised reasonable efforts to communicate the request.

Clients requiring services related to disabilities or reduced mobility are encouraged to discuss their requirements before booking so that the Company can assess the suitability of the proposed itinerary and identify practical solutions wherever possible.

The Company remains committed to providing personalized travel experiences while recognizing that certain operational limitations may exist, particularly within remote wilderness environments.

Dietary Requirements

Maasai Way Safaris is committed to ensuring that every Client enjoys meals that are safe, satisfying, and appropriate to their dietary needs wherever reasonably possible.

Clients with dietary requirements, food allergies, religious dietary restrictions, or medically necessary nutritional considerations should notify the Company in writing during the booking process or as early as possible before departure.

Examples include, but are not limited to:

  • Vegetarian
  • Vegan
  • Gluten-free
  • Lactose intolerance
  • Nut allergies
  • Seafood allergies
  • Halal meals
  • Kosher meals
  • Low-sodium diets
  • Diabetic meal requirements
  • Religious fasting considerations

Upon receiving such information, Maasai Way Safaris will make every reasonable effort to communicate these requirements to accommodation providers, safari camps, restaurants, mountain cooks, and other relevant suppliers.

While most hotels, lodges, and camps can accommodate common dietary requests, availability may vary depending upon the location, season, supplier capabilities, and remoteness of the destination.

Clients should recognize that certain specialized ingredients may not always be available within remote safari camps, mountain expeditions, or isolated regions of Tanzania.

For this reason, the Company cannot guarantee that every dietary request can be fulfilled exactly as requested in every location.

Clients with severe or life-threatening food allergies remain responsible for informing guides directly at the commencement of the tour and for carrying any emergency medication, including epinephrine auto-injectors or other prescribed treatments, where appropriate.

Mountain expeditions require particularly careful meal planning due to the logistical challenges of transporting fresh supplies to high altitude. Although our mountain teams prepare nutritious meals specifically designed to support climbers during the ascent, menu flexibility may be more limited than in hotels or restaurants.

Maasai Way Safaris will continue to work closely with suppliers to provide the highest possible standard of catering while respecting cultural traditions, local food availability, and environmental sustainability. Every reasonable effort will be made to ensure that dietary requirements communicated in advance are accommodated to the greatest extent practicable without compromising food safety or operational logistics.

Travel Insurance

Comprehensive travel insurance is a mandatory requirement for all Clients traveling with Maasai Way Safaris. Travel within Tanzania often involves remote wilderness areas, mountain environments, marine excursions, and locations where immediate access to advanced medical facilities may be limited. Comprehensive insurance provides essential financial protection for both the Client and the Company in the event of unforeseen circumstances.

Clients are responsible for obtaining suitable travel insurance from a reputable insurance provider before the commencement of their journey. The insurance policy should remain valid for the entire duration of travel, including international transit to and from Tanzania.

At a minimum, the insurance policy should provide adequate coverage for:

  • Emergency medical treatment
  • Hospitalization
  • Medical evacuation
  • Repatriation
  • Trip cancellation
  • Trip interruption
  • Travel delays
  • Lost or delayed baggage
  • Personal liability
  • Theft of personal belongings
  • Adventure activities where applicable

Clients participating in Mount Kilimanjaro expeditions must ensure that their insurance specifically covers high-altitude trekking up to 5,895 metres (19,341 feet) above sea level, together with emergency evacuation where available.

Certain standard travel insurance policies exclude mountain climbing, trekking, scuba diving, or other adventure activities. It remains entirely the Client's responsibility to verify that adequate coverage has been obtained.

Maasai Way Safaris reserves the right to request proof of travel insurance before the commencement of any tour.

Failure to obtain appropriate travel insurance shall not create liability on the part of Maasai Way Safaris for costs that would ordinarily be recoverable under a valid insurance policy.

The Company strongly recommends purchasing travel insurance immediately after confirming a booking to ensure cancellation protection is effective from the earliest possible date.

Emergency Evacuation

Although emergencies are uncommon, Maasai Way Safaris maintains procedures designed to respond promptly and responsibly should an emergency arise during the Client's journey.

In the event of illness, injury, accident, or other emergency requiring medical attention, the Company will make every reasonable effort to assist the Client in obtaining appropriate medical care as quickly as circumstances permit.

Depending on the location and severity of the incident, emergency response may involve:

  • Transfer to the nearest medical facility.
  • Ground ambulance transportation.
  • National Park rescue services.
  • Helicopter evacuation where available.
  • Coordination with local emergency authorities.
  • Communication with the Client's emergency contact.
  • Assistance with insurance documentation.

Emergency evacuation services are operated by independent providers and remain subject to weather conditions, terrain accessibility, government authorization, operational availability, and safety considerations.

The costs associated with emergency transportation, rescue services, hospitalization, medical treatment, evacuation flights, accommodation during recovery, and repatriation remain the responsibility of the Client unless covered by their travel insurance.

For Mount Kilimanjaro expeditions, evacuation procedures follow the regulations established by Kilimanjaro National Park Authority (KINAPA). Decisions regarding emergency descent or evacuation shall be made by qualified mountain guides in consultation with park rescue personnel where appropriate.

The Company shall not be responsible for delays resulting from weather conditions, terrain, communication limitations, or circumstances beyond its reasonable control that may affect emergency response times.

Clients agree to cooperate fully with guides, medical personnel, rescue teams, and emergency authorities during any evacuation procedure.

Guide Authority

The professional guide assigned by Maasai Way Safaris serves as the Company's official representative throughout the duration of the journey.

Clients acknowledge that guides are responsible for ensuring the safety, coordination, and smooth operation of the itinerary while maintaining compliance with National Park regulations, conservation policies, accommodation procedures, transportation requirements, and applicable laws.

For safety reasons, Clients agree to follow all lawful instructions issued by their guide throughout the tour.

Guide instructions may relate to:

  • Wildlife safety.
  • Vehicle safety.
  • Mountain safety.
  • Marine safety.
  • National Park regulations.
  • Environmental protection.
  • Local customs.
  • Cultural etiquette.
  • Emergency procedures.
  • Daily travel schedules.

Where a guide reasonably believes that a Client's behavior presents a risk to themselves, other travelers, staff members, wildlife, local communities, or Company property, the guide shall have authority to suspend participation in specific activities or terminate the Client's participation in the tour.

Examples include:

  • Dangerous behavior around wildlife.
  • Refusal to follow safety instructions.
  • Physical or verbal abuse.
  • Harassment.
  • Excessive intoxication.
  • Illegal drug use.
  • Criminal activity.
  • Damage to property.
  • Possession of prohibited items.
  • Repeated disruption affecting other guests.

Such decisions shall be made solely in the interests of safety and operational integrity.

Removal from the tour under these circumstances shall not entitle the Client to any refund or compensation.

Client Responsibilities

Every Client shares responsibility for ensuring a safe, enjoyable, and respectful travel experience.

By confirming a booking, Clients agree to conduct themselves responsibly throughout the duration of the journey.

Clients are responsible for:

  • Providing accurate personal information.

Clients are expected to behave respectfully toward fellow travelers, guides, drivers, accommodation staff, porters, cooks, local residents, conservation officers, and all individuals encountered during the journey.

The use of illegal drugs is strictly prohibited.

Any Client whose conduct places others at risk or significantly disrupts the travel experience may be removed from the tour without refund.

Clients are financially responsible for any loss or damage caused intentionally or through negligence to Company property, safari vehicles, accommodation facilities, equipment, or third-party property.

The Company encourages responsible tourism and asks all Clients to contribute to environmental conservation by minimizing waste, avoiding single-use plastics where possible, respecting wildlife habitats, and supporting local communities responsibly.

Photography

Tanzania offers extraordinary opportunities for photography and videography. Clients are welcome to take photographs and videos for personal enjoyment throughout their journey provided such activities do not interfere with safety, wildlife welfare, local customs, or the enjoyment of other guests.

Certain protected areas, museums, cultural sites, military facilities, airports, government buildings, and private properties may restrict photography.

Clients remain responsible for complying with all applicable photography regulations.

Drone photography is prohibited within most National Parks and protected areas unless official government permits have been obtained in advance.

Clients wishing to operate drones are solely responsible for securing all required authorizations before travel.

Out of respect for local communities, Clients should request permission before photographing individuals, particularly during cultural visits.

Maasai Way Safaris may occasionally photograph or record activities during tours for promotional purposes.

Where identifiable images of Clients are intended for marketing, social media, brochures, or website publication, the Company will seek the Client's consent wherever reasonably practicable.

Clients who do not wish to appear in promotional material should notify the Company in writing before or during the tour.

Privacy

Maasai Way Safaris is committed to protecting the privacy and personal information of every Client.

Personal information collected during the booking process may include names, passport details, contact information, travel dates, emergency contacts, medical disclosures, dietary requirements, payment information, and other details necessary for the administration of the booking.

This information is collected solely for legitimate business purposes, including:

  • Processing reservations.
  • Confirming accommodation.
  • Arranging transportation.
  • Securing National Park permits.
  • Coordinating domestic flights.
  • Providing customer support.
  • Meeting legal obligations.

Personal information will only be shared with third-party suppliers where necessary for the delivery of booked services.

The Company does not sell, rent, or knowingly disclose Client information to unrelated third parties for marketing purposes.

Reasonable administrative, technical, and organizational measures are maintained to safeguard Client information against unauthorized access, misuse, alteration, or disclosure.

Clients may request access to personal information held by the Company or request correction of inaccurate information by contacting Maasai Way Safaris directly.

Limitation of Liability

Maasai Way Safaris shall exercise reasonable skill, care, and diligence in arranging and delivering the travel services described within the confirmed itinerary.

However, the Company shall not be liable for losses, injuries, delays, expenses, or damages arising directly or indirectly from circumstances beyond its reasonable control.

These may include, but are not limited to:

  • Natural disasters.
  • Weather conditions.
  • Wildlife encounters.
  • Government actions.
  • Airline delays.
  • Road conditions.
  • Supplier failures.
  • Force Majeure events.
  • Illness.
  • Theft.
  • Loss of personal belongings.
  • Actions of third parties.

The Company's liability shall be limited to the value of the travel services purchased directly from Maasai Way Safaris, except where otherwise required by applicable law.

Nothing contained within these Terms shall exclude liability for fraud, willful misconduct, or any liability that cannot lawfully be excluded under the laws of the United Republic of Tanzania.

Clients acknowledge that participation in safari activities, mountain trekking, marine excursions, and other adventure travel involves inherent risks which cannot be entirely eliminated despite appropriate safety measures.

Participation in such activities is undertaken voluntarily and with full knowledge of these inherent risks.

Complaints

Maasai Way Safaris is committed to delivering exceptional service and values feedback from every Client.

Should any concern arise during the journey, Clients are encouraged to notify their guide or the Company's operations team immediately.

Prompt communication allows most issues to be resolved while the tour is still in progress.

Where a concern cannot be resolved during travel, Clients should submit a written complaint to the Company within 30 days following completion of the itinerary.

Complaints should include:

  • Booking reference.
  • Travel dates.
  • Description of the issue.
  • Supporting documentation where available.
  • Preferred resolution.

The Company will acknowledge receipt of the complaint and undertake a fair investigation.

Every reasonable effort will be made to provide a substantive response within 30 business days, although more complex matters involving third-party suppliers may require additional time.

The Company remains committed to resolving complaints professionally, fairly, and in good faith.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania.

Any dispute arising out of or relating to these Terms, the booking agreement, or the services provided by Maasai Way Safaris shall first be addressed through good-faith negotiations between the parties.

Where a mutually satisfactory resolution cannot be achieved, the parties agree to consider mediation or other alternative dispute resolution mechanisms before commencing formal legal proceedings, where appropriate.

Should legal proceedings become necessary, the courts of the United Republic of Tanzania shall have exclusive jurisdiction, unless otherwise required by mandatory provisions of applicable international law.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
